COntext menu doesn't appear if in main frame

Description
if i show a list (say a news list) via an action (so that the tree frame is not shown, there are just the module list and the list frame), then the context menu doesn't work, when clicking on a record's icon.
it "tries" to load it, but it is not show.
it works perfectly if the list is shown in the third frame (with the middle page tree shown)

i'm having big problems with editors, since of this bug.. don't you?
they get the records list via task Center action, and then can't anymore edit anything, unless they go to "extended view"

bug partially solved by my http://bugs.typo3.org/view.php?id=2245 patches (opens the new frames aside the taskccenter column)

with 4.0beta1 (and AJAX clickmenu loading) the submenu does loads always, but the buttons don't work
(i remind it: only if you use a task center action, like "list records") WITHOUT having patched with bugfix

I tried with 4.2.0 and it works there (see screenshot). Clicking on the edit item works too.
