Admin Panel and Edit Panel are not consistent

Description
1. The admin panel - edit options like add new content element etc do not use the pop-up window option - they always use _top even when the edit panel opens a pop up window.
2. The "new record after" in the edit panel does not use newContentWiz.overrideWithExtension while add new content element in the admin panel does. (issue relevant for templavoila)
This certainly does not inhibit the functionality of FE-editing but it does confuse editors (in my eyes to a degree where using it is not a real option)
Can extMakeToolBar() in t3lib_tsfebeuserauth.php be brought into line with editPanelLinkWrap() and editPanelLinkWrap_doWrap() in t3lib_content.php?

relates to 1): this point refers somehow to bug 2266 but not to bug 4198 which is supposed to be a duplicate - while the diff file of bug 4198 does not change this specific behavior, the extension tm_contentaccess (see bug 2266) solves the problem - however this should still go into the core, shouldn't it?

As this report is very old, is the handling in newer TYPO3 CMS Versions (like 6.0/6.1) more like you expect it?
