patch attached
somehow, a trivial bug has survived all the way thru debugging:
in both functions there exists the line:
if (!$script) {basename(PATH_thisScript);}
obviously, this has no effect.
theses lines (copied from the function getFuncMenu) do the job:
if (!$script) {
$script = basename(PATH_thisScript);
$mainParams.= (t3lib_div::_GET('M') ? '&M='.rawurlencode(t3lib_div::_GET('M')) : '');
}

The issue is very old, does this issue exists in newer versions of TYPO3 CMS (4.5 or 6.1)?
