The file reference to media/scripts/jsfunc.layermenu.js is hardcoded into gmenu_layers.php.
Removal of symlinks as in the new typo3-version breaks the menu because the media folder no longer exists on root level
(issue imported from #M2632)

I cannot say when this was changed, but at least in RC2 it seems fixed!
