Logically if table is hidden, creation should not be allowed either.
The following code in typo3/class.db_list.inc near line 229 should be extracted to some other place (t3lib_BEfunc???) and made common:
if (isset($this->tableTSconfigOverTCA[$tableName.'.']['hideTable']) ? $this->tableTSconfigOverTCA[$tableName.'.']['hideTable'] :
(t3lib_div::inList($this->hideTables, $tableName) ? true : $GLOBALS['TCA'][$tableName]['ctrl']['hideTable'])) {
continue;
}
Then typo3/db_new.php should be patched near line 427 to use this method.

The issue is very old, does this issue exists in newer versions of TYPO3 CMS (4.5 or 6.1)?
