HMENU with special = list does not use versionOL

Description
A typoscript menu with special = list does not use the versionOL functions. In consequence this menu type does not work proper with workspaces.
By using the content element menu/sitemap or custom typoscript code/extensions it is not possible to use workspaces like expected.
The code of tslib_tmenu seems to be little consequent on this issue. The special=directory uses the versionOL functions, list does not. We could not anticipate any reason. So we think it is simply a bug. We fixed it by doing a XCLASS on tslib_tmenu.
We had a similar issue with dam, but we will report this in an extra ticket.

The issue is very old, does this issue exists in newer versions of TYPO3 CMS (4.5 or 6.1)?
