TemplaVoila FCE > overwrite image > error: The fields marked with a yellow ....

Description
Summary:
Flex CE image must be deleted before it can overwritten by other image, else I get javascript popup error: "The fields marked with a yellow exclamation mark are not yet correctly filled in. Please complete them properly."
1) TemplaVoila Flexibele Content Element template with 1 image field to upload 1 image.
2) Create new page with above FCE.
3) Add image with the button "Browse for files" and save the page (save + close OR only save).
4) Overwrite image > click image button "Browse for files" and save the page. Then this error appears: "The fields marked with a yellow ...."
5) Only when I first delete the image with x button (remove selected items), I can replace it with an other image.

Hi,
as this issue is very old. Does the problem still exists within newer versions of TYPO3 CMS (6.2.3)?
