Flexform section alone inside another section not possible

Description

If you create a flexform with sections for TV or another extension and you have insided of one section just another section and no fields then it doesn't work to add elements of the second level section.

You add the first level. This works. Then you can select a "NEW" element for the second level but if you save again the first level is gone again.
