Drag 'n Drop is not working in some situations

Description
Using:
'appearance' => array(
'useSortable' => 1,
),creates the icon, but trying to drag doesn't make the records move. At the same time when loading the record up the both up and down arrows is shown on all records, including the first and last. Those icons disappear after clicking any arrow up or down which also moves the record correctly.
Screendump shows the arrows.
I have sent Oliver a screencast with this so he has seen the problem on my test installation.

I will try to do a test one of these days, though it is quite some time ago I reported this problem, so I need to try to see if I figure out how it was ;)

Nope, I cannot reproduce this problem anymore. it must have been solved with one of the updates. There's been a few :)
