TYPO3 9 still checks and reports typo3conf/l10n as missing in install tool

Description
The label location in TYPO3 is var/labels, the install tool still wants to create public/typo3conf/l10n however. This check should be removed or at least be extended to be smart enough to detect if this directory is actually needed in the current setup.
Location of the configuration is: ext:install/Classes/FolderStructure/DefaultFactory.php:136
