Checkbox for mass action didn't apear if user have only publish/swap permission

Description

If an element is in review stage and the review user has permission to publish the element (but is no admin), the checkbox for mass action didn't appears.

Attached patch shows the checkbox again, but I didn't found the event listener so the checkbox don't work.

But I don't understand why do this check - if you can't do anything with the record, it wouldn't shown - so why don't add the checkbox always?
